Terms of Service

These Terms of Service ("Terms") form a binding agreement between you and UltraSinter Manufacturing ("USM", "we", "us"). By accessing this website, creating an account, requesting a quote, or placing an order, you agree to these Terms. If you do not agree, do not use the site or place an order.

We may update these Terms from time to time. The "last updated" date above reflects the current version. Continued use of the site after an update means you accept the revised Terms.

You must be at least the age of majority in your jurisdiction to create an account or place an order. By placing an order, you represent that you are legally eligible to purchase the products you have selected and that all information you provide is accurate and complete.

Most USM products are made to order. Each build is configured at the time of order — housing platform, optics, tube selection, finish color, and accessories. Production begins after order confirmation. Made-to-order products are produced for a specific buyer and may not be cancellable or returnable once production has begun.

Product photographs and descriptions are illustrative. Exact appearance, finish, and component lots may vary across production batches. Specifications and configurations may be updated without notice. USM does not imply any consumer warranty by description, photograph, or specification listing; warranty terms are governed by USM's written warranty policy.

All prices are listed in U.S. dollars and exclude taxes, shipping, and any applicable duties unless explicitly stated. Prices and configurations may change without notice prior to order acceptance. USM reserves the right to correct pricing errors and to refuse or cancel orders placed at an obviously incorrect price.

Payment is processed by Square at checkout. By placing an order you authorize the payment for the full amount of the order at the time of submission. We accept the payment methods displayed at checkout. For custom or dealer/agency orders, alternate payment terms may be confirmed in writing prior to production.

Many night vision products, components, optics, image intensifier tubes, and related technical data are controlled under U.S. law, including the International Traffic in Arms Regulations (ITAR) and the Export Administration Regulations (EAR). Customers are responsible for compliance with all applicable export-control laws. Restricted products may not be exported, re-exported, transferred, loaned, hand-carried, shipped, or disclosed to foreign persons without proper authorization.

USM may require export-compliance attestation before scheduling certain builds and may cancel or refuse any order that appears to violate these rules. See the ITAR / Export Notice for additional information.

We ship using the carriers selected at checkout. Shipping time begins after production is complete; the total time from order to delivery includes production lead time plus transit. Quoted lead times are estimates based on current scheduling and may shift. USM will notify you if your build is delayed materially beyond its quoted window.

Signature on delivery is required for high-value orders. Risk of loss transfers to you on delivery to the carrier. Insurance coverage is available and recommended on high-value orders. See Shipping & Returns for additional detail.

Custom or made-to-order products are typically non-refundable once production has begun. Cancellation requests are reviewed on a case-by-case basis; orders that have not yet entered production are typically cancellable. Stock items may be returnable within a defined window in unused, original condition, subject to USM approval and any restocking fees disclosed at the time of order.

Damaged or defective items should be reported within 48 hours of delivery with supporting photographs. Warranty claims are governed by USM's written warranty policy — see Warranty for terms.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, USM AND ITS OFFICERS, EMPLOYEES, AGENTS, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION LOST PROFITS, LOST REVENUE, LOST DATA, LOST OPPORTUNITY, OR LOSS OF GOODWILL, ARISING OUT OF OR RELATED TO THE SITE, AN ORDER, OR USE OF A USM PRODUCT.

USM'S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO AN ORDER WILL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE PRODUCT GIVING RISE TO THE CLAIM. Some jurisdictions do not allow the exclusion or limitation of certain damages; in those jurisdictions, our liability is limited to the maximum extent permitted by law.

You agree to indemnify, defend, and hold harmless USM and its officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your violation of these Terms, your misuse of a USM product, or your violation of any applicable law including export-control regulations.

The site, including text, photography, graphics, logos, and product designs, is the property of USM or its licensors and is protected by U.S. and international intellectual property laws. You may not copy, modify, distribute, sell, or create derivative works from any portion of the site without prior written permission.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify USM immediately of any unauthorized access. USM may suspend or terminate accounts that violate these Terms or pose a security risk.

These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict-of-laws principles. The exclusive venue for any dispute arising out of or related to these Terms or an order shall be the state and federal courts located in Pennsylvania, and you consent to the personal jurisdiction of those courts.

If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect. The invalid provision will be replaced by an enforceable provision that most closely reflects the original intent.
